We recently hired someone from an agency to come and work for us over the christmas period . They have now finished with us, and were asking for our advice as they have been asked to pay a comission by the agency for finding them a job. Am I right to advise them to take legal advice as I don't think the agency should be doing this?

It depends entirely on the contract they had with the agency, but I doubt it very much. I take it you paid the agency for providing you with a temp?

Yes we followed the normal procedures that you would for using somebody from an agency, it's just that it seems a little perculiar what they are asking of this person, and just wanted another opinion before I advise them.
No reputable agency should be charging candidates to find them a job! the agency either gets a commission from the employer on the candidates earnings or as in our case we charge a fee upon employment to the retailer, then if the candidate leaves within the first few weeks, there is usually an agreement of a full refund or rebate on a sliding scale or credit note towards further recruitment costs.
