I need some help on advising a friend. Basicly, he was promoted around 6 months ago and has only now discovered that ha should have been earning more money than he should of at standard rate. He brought this to the attention of his managers, who have now sorted this out. But Is he entitled to six months of back pay?
Did they sign a new contract with their promotion?

No they didn't. The company he works for said that it wasn't nescessary when he asked.

I'm not sure on this one. If they didn't sign a contract then they have no written agreement so I can't imagine it's worth fighting for as you may be wasting your time . As I said i'm not 100% certain though.

I can't beleive the company said is wasn't needed..
By law, a employer should provide a contract, or a change in contract (known as a "statement of terms") within 2 months of starting employment or even a change in terms i.e (promotion with greater remuneration)
If this is not done then the employer has in effect breached the terms and conditions of their employment.
If your friend wishes to exersise their right to claim back pay they could do so if they so.
There is the possibility that the employer would look on this with a dim view but there is not really a lot they could do in the eyes of the law.

Rob, did you get this sorted out? Did the company backdate your pay?
